1. DEFINITIONS
In these General Terms and Conditions, the following definitions shall apply:
1. Consumer: the natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur;
2. Agreement at a distance: an agreement whereby in the framework of a by L' Atelier du Champagne B.V. organised system for sale at a distance of products and/or services, up to and including the closing of the agreement exclusive use is made of one or more techniques for communication at a distance;
3. Technique for distance communication: means that can be used for closing an agreement, without that consumer and L' Atelier du Champagne B.V. have come together simultaneously in the same space;
4. Reflection period: the period within which the consumer can make use of his right of withdrawal;
5. Right of withdrawal: the possibility for the consumer to waive the distance contract within the reflection period;
6. Day: calendar day.

2. APPLICABILITY
2.1 These general conditions are applicable on all offer of L‘ Atelier du Champagne B.V. in its web shop (latelierduchampagne.nl) and on all between the consumer and L’ Atelier du Champagne B.V. contracted agreements on distance. By ordering in the web shop, the consumer accepts the general conditions.
2.2 Besides these general conditions can, when explicitly indicated, additional conditions apply on certain products.

3. ESTABLISHMENT OF THE AGREEMENT

3.1 The agreement comes about at the moment that consumer has accepted the offer of L' Atelier du Champagne B.V. electronically.
3.2 If consumer has accepted the offer electronically, confirms L' Atelier du Champagne B.V. immediately electronically the reception of the acceptance of the offer. As long as the receipt of this acceptance has not been confirmed, the consumer can dissolve the agreement.
3.3 L' Atelier du Champagne B.V. takes appropriate technical and organisational measures to protect the electronic transfer of data and ensures a safe web environment. If the consumer pays electronically, L' Atelier du Champagne B.V. will observe appropriate safety measures.
3.4 L' Atelier du Champagne B.V. can - within legal frameworks - inform itself whether consumer can satisfy its payment obligations, as well as of all those facts and factors which are important for a responsible conclusion of the agreement at a distance. If L' Atelier du Champagne B.V., on the basis of this investigation, has good grounds to not enter into the agreement, it is entitled to refuse an order or request, motivated.

3.5 It stands L' Atelier du Champagne B.V. free to refuse an order or request or to attach special conditions to the implementation. This choice lies entirely at L' Atelier du Champagne B.V. and it does not have to motivate this. If L‘ Atelier du Champagne B.V. refuses an order or application, L’ Atelier du Champagne B.V. notifies this immediately to the consumer.

4. THE OFFER

4.1 If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
4.2 The offer contains a complete and accurate description of the products and/or services on offer. The description is sufficiently detailed to enable a good assessment of the offer by the consumer. If L' Atelier du Champagne B.V. makes use of images these are a truthful representation of the offered products and/or services. Apparent mistakes or errors in the offer do not bind L' Atelier du Champagne B.V..
4.3 The Internet site contains such information, that for the consumer is clear what the rights and obligations are, which to the acceptance of the offer are connected. This concerns in particular. - The price including taxes; - The possible costs of delivery; - The manner in which the agreement will be concluded and which actions are necessary for this. - Whether or not the right of withdrawal applies; - The method of payment, delivery or performance of the agreement; - The period for accepting the offer, or the period for adhering to the price.
4.4. L' Atelier du Champagne B.V. pays much attention to the most accurate as possible display of the product colours on the latelierduchampagne.nl website. However, we cannot guarantee that the colours are correctly displayed on your monitor because of monitor settings.

5. PRICE / SHIPPING COSTS

5.1 The prices at the time of ordering a product apply. All prices are initially expressed in Euros, in accordance with the legal regulations on the subject, and include sales tax (21%).
5.2 Special offers are only valid for the period of validity stated with that offer. This statement is displayed on the internet site relating to that special offer.
5.3 The prices mentioned in the webshop do not include shipping costs.

6. PAYMENT

6.1 Orders via the webshop can be paid in the following ways:
- iDEAL;
- MasterCard;
- Visa;
- American Express;L' Atelier du Champagne B.V. can extend the payment possibilities. Other payment possibilities will then in any case be made known via the internet site.
6.2 In the case that with L' Atelier du Champagne B.V. a term of payment has been agreed upon, applies that by the only expiring of this term the consumer is in neglect. Payment terms can only be agreed upon in writing under then to be set and to be agreed upon conditions.
6.3 At the expense of the consumer come all (extra-)judicial costs of which nature thus, including collection costs, which L' Atelier du Champagne B.V. as a result of non-fulfilment by the consumer of its (payment) obligations will make.
6.4 In case of non-timely payment, L' Atelier du Champagne B.V. is competent to dissolve the agreement with immediate effect or to postpone (further) delivery until the moment on which the consumer has completely fulfilled his payment obligations, the payment of costs as meant in article 6.3 included.

7. DELIVERY

7.1 L' Atelier du Champagne B.V. sends, itself or via a third party, the accepted orders as soon as possible in order of receipt. If a product is in stock, the product will be sent within 48 hours after the order.
7.2 If a delivery cannot take place or not within the average period, for example in case the products are not in stock, the consumer will be informed as soon as possible.

8. RETURNS AND RIGHT OF WITHDRAWAL

8.1 The consumer is obliged to carefully inspect the products (or have them inspected) immediately upon receipt.
8.2 We naturally want you to be satisfied and strive to achieve this through extensive product information on this website. We grant consumers 14 calendar days' reflection time after receipt of the order. If you are still not satisfied with your order, you can return it to us.

 If you return your entire order, we will refund the full amount paid to the account you used to pay for it, including the shipping costs. The costs of returning your order to us are for the buyer's account. To return a product, we will send you a return label with the special return address and your personal return number pre-printed. Please contact us for this via email: info@latelierduchampagne.com . Excluded from the right of return are personalised products that are engraved or printed, for example. Of course, the items must be in undamaged condition and unopened. As specific storage conditions are required to keep vintage champagnes in good condition, these drinks cannot be returned.

Insufficiently or unstamped returns will not be accepted by us. If you return an item outside the specified conditions, the payment obligation does not lapse.
8.3 Exchanges are not possible.

9. RETENTION OF TITLE

9.1 The articles remain property of L' Atelier du Champagne B.V. until the complete invoice amount has been paid by the consumer.
9.2 The consumer cannot encumber, sell, resell, alienate or otherwise encumber the products before the ownership has been transferred.

10. GUARANTEE AND LIABILITY

10.1 L' Atelier du Champagne B.V. guarantees that the products and/or services meet the agreement, the specifications mentioned in the offer, to the reasonable requirements of reliability and/or usefulness and on the date of the realisation of the agreement existing legal provisions and/or government regulations.
10.2 L‘ Atelier du Champagne B.V. is never obliged to pay any direct or indirect damages to the consumer or others, unless there is intention or grove debt on the side of L’ Atelier du Champagne B.V..
10.3 If L' Atelier du Champagne B.V., for whatever reason, is obliged to compensate any damage, the compensation will never be higher than an amount equal to the invoice value concerning the product by which the damage has been caused.
10.4 Despite the constant care and attention that L' Atelier du Champagne B.V. devotes to the composition of the Internet site, it is possible that information published on the Internet site is incomplete and/or incorrect.
10.5 The information on the Internet site is regularly supplemented and/or adapted. L' Atelier du Champagne B.V. reserves the right to make any changes with immediate effect and without notification.

10.6 The consumer is obliged to safeguard L‘ Atelier du Champagne B.V. for any claim which third parties concerning the implementation of the agreement against L’ Atelier du Champagne B.V. could do, as far as the law does not prevent that the concerning damage and costs must come at the expense of the consumer.
10.7 It is possible that L' Atelier du Champagne B.V. on its Internet site links to other Internet sites that possibly interesting or informative for the visitor can be. Such links are purely informative. L' Atelier du Champagne B.V. is not responsible for the contents of the Internet site to which is referred or the use that can be made thereof.

11. FORCE MAJEURE

11.1 In case of force majeure, L' Atelier du Champagne B.V. is not obliged to fulfil its obligations towards the consumer, respectively the obligation is suspended for the duration of the force majeure.
11.2 Force majeure means every circumstance independent of its will, as a result of which the fulfilment of its obligations towards the consumer is fully or partially prevented. Such circumstances include, inter alia, strikes, fires, operational disruptions, energy disruptions, non-delivery or late delivery by suppliers or other third parties engaged and the absence of any permit to be obtained through the government. Furthermore, force majeure is understood to mean breakdowns in a (telecommunication) network or connection or communication systems used and/or the unavailability of the internet site at any time.

12. INTELLECTUAL PROPERTY

12.1 The consumer acknowledges explicitly that all rights of intellectual property of displayed information, signs, communications or other expressions concerning the products and/or concerning the Internet site rests at L' Atelier du Champagne B.V., to its affiliated companies, its suppliers or other claimants. Under intellectual property rights are understood patent, author, brand, drawings and model rights and/or other (intellectual property) rights.
12.2 Consumer undertakes not to infringe the intellectual property rights as described in this article.

13. PRIVACY / COOKIES

13.1 By ordering the consumer gives simultaneously permission to L' Atelier du Champagne B.V. if necessary the personal data of the consumer to use. L' Atelier du Champagne B.V. uses the data of consumer only as far as necessary for the implementation of the service provision. The personal data provided by the consumer will not be provided to a third party for commercial purposes without the consumer's consent.
13.2 The data of the consumer are kept only as far as necessary for the realisation of the purposes for which the personal data are obtained and processed by L' Atelier du Champagne B.V.. Besides the execution of the agreement, this means the realisation of marketing purposes and the maintenance of the customer relationship with the consumer.
13.3 L' Atelier du Champagne B.V. makes use of cookies. Cookies are small files that are placed on your computer to facilitate the use of the website for you. These cookies remember, for example, your login details and passwords, but also the products you have put in your shopping basket. These cookies allow us to measure the number of visits to our site and thus collect statistics that allow us to improve the customer experience of our website.

14. AGE LIMIT

14.1 L' Atelier du Champagne B.V. does not accept orders from persons under 18 years of age.

15. APPLICABLE LAW

15.1 On all offers and agreements of L' Atelier du Champagne B.V. is exclusively Dutch law applicable.

16. DISPUTES

16.1 For questions and/or complaints, consumers may fill in the contact form or send an email to info@latelierduchampagne.nl. Complaints are usually dealt with within 24 hours. If this is not possible for any reason, the consumer will be informed of the delay time.
16.2 The consumer has the opportunity to submit the dispute to an independent dispute committee. This may be the Thuiswinkel disputes committee or another equivalent disputes committee, which does not affect the consumer's right to submit the dispute to a competent court.
